Terms of Sale

In this section, we aim to clarify any doubts regarding the General Terms and Conditions of Online Sale of consumer goods (hereinafter referred to as the "General Terms"), warranty terms, and shipping costs.

We recommend that our customers carefully review the sections provided on this page to avoid any misunderstandings. Additionally, our customer service representatives are always available to clarify any doubts and provide further information.

The goods covered by these General Terms are sold by Bizantini S.r.l., headquartered in Ravenna, Via Capodistria No. 23, Postal Code 48122, Tax Code and Business Register Number 02683050393 (hereinafter referred to as the "Company").

Article 1 – Definitions

  • Company: Refers to Bizantini S.r.l., the company selling products via the Internet as part of its production assortment.

  • Biscotti Bizantini: Refers to the trademark applied to the products owned by the Company.

  • Customer: The purchaser of the products who qualifies as a consumer, meaning a natural or legal person who makes a purchase for purposes not related to any professional or commercial activity.

  • Consumer Code: Refers to the provisions of Legislative Decree No. 206 of September 6, 2005.

  • General Terms: Refers to these General Terms and Conditions of Online Sale of consumer goods.

  • E-commerce: The set of sales and purchase activities conducted via the Internet.

  • Force Majeure: Refers to extraordinary and unforeseeable events that prevent or make the regular execution of the contract excessively burdensome. These include, but are not limited to, government regulations, courier strikes, and other circumstances beyond the Company's control, including delays in delivery not directly attributable to the Company.

  • Islands: Refers to the regions of Sicily and Sardinia and their respective archipelagos.

  • Promotions: Sales made by the Company for all or part of its products, for limited periods, with an extraordinary discount on the selling price.

  • Products: All consumer goods and/or merchandise produced and marketed by the Company and part of its assortment.

  • Product Sheet: Indicates the essential characteristics of each product under the Biscotti Bizantini brand.

  • Service(s): The online sale of Biscotti Bizantini branded food products owned by the Company.

  • Website: The collection of web pages associated with biscottibizantini.it, through which the Services are offered.

Article 2 – Pre-Contractual Information

Pursuant to Article 49 of Legislative Decree 206/2005, the Company provides these General Terms with all legally required pre-contractual information. Customers may contact our customer care service for any additional information at info@biscottibizantini.com.

Article 3 – General Provisions

These General Terms govern the purchase of Products made remotely via the biscottibizantini.it website, owned by the Company.

Purchase operations are regulated by Legislative Decree No. 206 of September 6, 2005 (Consumer Code), while privacy protection is subject to Legislative Decree 196/03, as amended by EU Regulation 679/2016 (GDPR).

By placing an order, the Consumer confirms that they have read and accepted these General Terms and authorizes the Company to execute them accordingly.

Article 4 – Contract Purpose

The Company, through the website biscottibizantini.it, offers an online sales service for Biscotti Bizantini-brandedfood products, along with their shipment. The Company may also sell items from commercial partners collaborating with Biscotti Bizantini. The essential characteristics of the Products are detailed within each Product Sheet.

Article 5 – Contract Conclusion

Contracts are finalized when the Customer accesses the Website and places an order using online communication technology.

All purchase orders sent to the Company must be correctly completed and must include the necessary details to identify the ordered products, the Customer, and the delivery address.

The Company reserves the right to charge additional costs if changes to the delivery address are not promptly communicated.

The purchase order submitted by the Customer is considered a contract proposal, valid online.

The contract is deemed concluded only upon the Company's acceptance, confirmed via an email confirmation.

The Company reserves the right not to accept incomplete or improperly completed orders.

Article 6 – E-commerce Characteristics and Shipping Costs

  • Prices are always VAT-inclusive.

  • Shipping is free for orders over €39.

  • The order will be processed only after payment confirmation.

Article 7 – Customer Obligations and Declarations

The Customer declares that they are of legal age and possess the legal capacity necessary to enter into a binding contract.

The Customer agrees to keep a copy of these General Terms after completing the online purchase process.

Before submitting an order, the Customer must review and accept these terms by marking the designated space on the Website.

The Customer commits to paying the purchase price within the time and manner specified in these General Terms.

Article 8 – Purchase Prices

Prices may change at any time without notice due to market conditions. However, the Customer is always guaranteed the price shown on the order confirmation page and in the corresponding email.

Article 9 – Limitation of Liability

The Company assumes no responsibility regarding how the Customer uses the purchased goods.

In the case of defective or damaged goods due to courier mishandling, the Company will replace only those items noted on the courier's delivery receipt.

The Company is not responsible for service disruptions caused by Force Majeure events.

Article 10 – Payment and Shipping Methods

PAYMENT METHODS

The Customer can pay in two ways:

  • Credit Card (via PayPal secure servers, accepting all major credit cards).

  • Bank Transfer (must include the order number as the payment reference).

SHIPPING METHODS

  • Italy: Orders are shipped Monday to Friday. A sales invoice will be included.

  • International: Customers must email export@biscottibizantini.com to confirm shipping costs and requirements.

  • Deliveries outside the EU may incur customs duties and taxes, which will be communicated before shipment.

Article 11 – Product Delivery and Risks

The delivery dates and times indicated by the Company should be understood as purely indicative estimates.

Generally, delivery is expected within 5 working days from payment verification, except for delays due to merchandise preparation or unforeseen courier issues. If payment is made via credit card, the order will be processed in real time, whereas if payment is made by bank transfer, the order will only be processed after the Company’s bank confirms receipt of the transfer.

Delivery is made to the address specified at the time of order, which may differ from the Customer’s address. If the recipient is not present during the specified delivery times, Biscotti Bizantini reserves the right to charge the Customer for additional redelivery costs.

In any case, delivery times shall not exceed 30 days from the day following the transmission of the order to Biscotti Bizantini or from the receipt of the advance bank transfer.

If the Customer wishes to change the delivery address after placing the order, they may contact Customer Service at +39 379 240 5652 or via email at info@biscottibizantini.com, specifying the purchase details and requesting the address change; the request will be accepted if the order has not yet been processed.

Upon delivery, it is recommended to check the integrity of the package. If, at the time of delivery, the package shows evident signs of tampering or damage that may have compromised the integrity of its contents, the Customer must note their observations on the receipt presented by the courier, adding the following statement: “damaged goods, accepted with reservation for further inspection.”

It is important that any complaints be immediately expressed to the courier and promptly communicated to our email address: info@biscottibizantini.com, along with photographic evidence of the damage; otherwise, the goods will be considered accepted.

Biscotti Bizantini will not be held responsible for undelivered goods due to an incomplete or incorrect address provided by the Customer. Any returns of undelivered goods will be charged to the recipient.

Once the goods have been accepted, the risk of loss or damage to the Product will be borne exclusively by the Customer.

Article 12 – Warranty and Right of Withdrawal

Biscotti Bizantini offers the “SATISFIED or REFUNDED” guarantee pursuant to Legislative Decree 206/2005, which establishes the right of withdrawal, allowing the Customer to return the purchased Product and obtain a refund of the amount paid. This right is reserved exclusively for natural persons (consumers) and cannot be exercised by legal entities or individuals acting for professional purposes.

The right of withdrawal must be exercised within 14 calendar days from the receipt of the Products by sending a registered letter with acknowledgment of receipt or via certified email (PEC), with prior notification by email to info@biscottibizantini.com or by phone at +39 379 240 5652.

In the withdrawal communication, the Customer must indicate the relevant order number and return the product to the following address: Via Capodistria 23, 48122, Ravenna.

Return shipping costs are entirely the responsibility of the Customer.

Cash-on-delivery or freight-collect packages will not be accepted.

The right of withdrawal is completely void if the returned product is not intact, meaning that:

  • The original packaging is missing;

  • Essential components of the Product are missing;

  • The Product is damaged for reasons other than transport;

  • Sealed products have been opened by the consumer.

In such cases, the Customer will be required to pay for the purchased Products.

Article 13 – Complaints

For any complaints, the Customer must promptly contact Customer Service at +39 379 240 5652 or via email: info@biscottibizantini.com, specifying the nature of the complaint.

Article 14 – Third-Party Rights

The Company shall not be liable for any infringement of intellectual property rights, copyrights, registered designs, trademarks, or other third-party rights caused by the Customer.

To this end, the Customer shall indemnify the Company against any liability, claims, and costs it may incur as a result of any activity by the Customer that causes or is alleged to cause a violation of third-party intellectual property rights.

Article 15 – Product Illustrations

All product descriptions, illustrations, representations, details, dimensions, performance data, and any other information available on the website should be understood as general illustrations of the Products and do not constitute any guarantee or statement of conformity.

Article 16 – Privacy

Bizantini S.r.l., as the Data Controller, processes the Customer’s personal data in accordance with applicable data protection laws and this privacy policy.

Personal data processing includes any operation or set of operations performed with or without automated processes applied to personal data, such as collection, registration, organization, structuring, storage, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, restriction, erasure, or destruction.

The Controller collects and/or receives personal data including: IP address, identifying personal data (such as name, surname, email address, and phone number) provided during navigation of the website https://www.biscottibizantini.it/.

Your personal data will not be disclosed to unauthorized parties.

Personal data is collected electronically and processed directly and/or by designated third parties exclusively for the following purposes:

  • Order processing and management;

  • Commercial and advertising purposes, including email communication.

Providing personal data is essential for completing the purchase process; refusal to provide data will prevent registration on the site and online purchases.

Personal data is stored in protected electronic archives with effective security measures against breaches. Data is retained for the time necessary to fulfill information requests and communications, for a maximum of 24 months, except in cases requiring intervention by competent authorities.

Marketing and promotional emails require the Customer’s explicit consent. Without consent, the Customer will not receive such communications, nor will personal data be used for purposes other than contract execution.

Customers have the right to:

  • Access, rectify, erase, restrict, or oppose data processing;

  • Obtain data portability;

  • Receive timely responses to requests within one month, extendable by two months with justification.

Article 17 – Applicable Law and Disputes

Any dispute related to the application, execution, interpretation, and violation of the online contract with Biscotti Bizantini is subject to Italian jurisdiction.

Disputes arising from the contract shall be resolved by the competent court in the Customer’s place of residence and relevant mediation bodies.
